Welcome to Molly's Boats. By accessing or using our website at mollysboats.com and booking our services, you agree to be bound by these Terms of Service. Please read them carefully.

1. Services

Molly's Boats provides private boat charters, fishing trips, bay tours, and related marine experiences departing from Hyde Street Harbor in San Francisco, California. All services are subject to availability, weather conditions, and captain discretion.

2. Bookings and Payments

  • All bookings are subject to availability and confirmation.
  • Payment is required at the time of booking unless otherwise arranged.
  • Payments are processed securely through Stripe or accepted in person (Venmo, cash).
  • Prices are listed in US dollars and are subject to change without notice.

3. Cancellations and Refunds

Cancellations made more than 48 hours before the scheduled departure may be eligible for a full refund or rescheduling. Cancellations within 48 hours are non-refundable. Molly's Boats reserves the right to cancel or reschedule trips due to unsafe weather conditions or mechanical issues, in which case a full refund or rescheduled trip will be offered.

4. Liability Waiver

All passengers are required to sign a liability waiver before boarding. Passengers under 18 must have a waiver signed by a parent or legal guardian. By booking a trip, you acknowledge that boating and water activities involve inherent risks including but not limited to drowning, hypothermia, collision, and equipment failure.

5. Passenger Conduct

  • Passengers must follow all safety instructions provided by the captain and crew.
  • The captain reserves the right to refuse service to anyone who appears intoxicated or poses a safety risk.
  • Illegal activities aboard the vessel are strictly prohibited.
  • Passengers are responsible for their personal belongings.

6. Use of Website

You agree not to:

  • Use the website for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the website or its systems
  • Interfere with the proper functioning of the website
  • Submit false or misleading information through any form

7. Intellectual Property

All content on this website, including text, images, logos, and design, is the property of Molly's Boats or its licensors and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works without prior written consent.

8. Google User Data

Our application uses Google APIs to send booking confirmations via Gmail and create calendar events for scheduled trips. Our use of Google user data is limited to these purposes and complies with the Google API Services User Data Policy, including the Limited Use requirements.

9. Third-Party Services

Our website integrates with third-party services including Stripe (payments), Google Calendar (scheduling), Google Maps (location), and WooCommerce (order management). Your use of these services is governed by their respective terms.

10. Limitation of Liability

To the fullest extent permitted by law, Molly's Boats shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the website or our services. Our total liability shall not exceed the amount you paid for the specific service giving rise to the claim.

11. Governing Law

These Terms shall be governed by the laws of the State of California. Any disputes arising from these Terms or your use of our services shall be resolved exclusively in the courts of San Francisco County, California.

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of our website or services after changes constitutes acceptance of the revised Terms.
